    Part B – Terms and Conditions on WhatsApp Services

    These terms and conditions (“WhatsApp Terms and Conditions”), as amended from time to time, are applicable to the Customers (defined hereinafter) that avail the Services (defined hereinafter) provided by BasketOption.Insure on the WhatsApp platform. The WhatsApp Terms and Conditions shall be in addition to any other terms and conditions as stipulated by Mazel Insurance Brokers Pvt. Ltd from time to time on its website (basketoption.insure) whether pertaining to the account or in relation to other products, services, facilities or offers provided by Mazel Insurance Brokers Pvt. Ltd and availed by the Customer.

    Any Services that may be offered to the Customer through the WhatsApp platform are at the discretion of the Company and/or based on the eligibility criteria of a customer.

    In case of inconsistency between the WhatsApp Terms and Conditions and any specific terms and conditions pertaining to a specific variant of the account or any specific service/product/offer, the specific terms and conditions of that particular service/product/offer shall prevail.


    1. Definitions

    Account
    “Account” means any policy account maintained by the Customer with BasketOption.Insure (Mazel Insurance Brokers Pvt. Ltd), including insurance policies, premium accounts, or related service accounts.

    Nature of Service

  • BasketOption.Insure acts as an insurance broker and technology facilitator.
  • The Company does not underwrite insurance policies.
  • The Company does not approve, reject, or settle claims.
  • Insurance contracts exist only between the Customer and the Insurance Company.
  • WhatsApp service is only an information access channel.

  • Registered Company Number
    The official WhatsApp number registered by BasketOption.Insure (Mazel Insurance Brokers Pvt. Ltd) to provide customer services.

    Platform Description
  • Responses may be generated through automated chatbot systems.
  • Human intervention may not always be involved.
  • Information provided is system-generated.

  • Scope of Services (WhatsApp)
    The WhatsApp bot provides the following services:
  • Retrieve insurance e-card
  • Display claim status
  • Show network hospital list
  • Policy information enquiry
  • Automated service responses
  • Service notifications and alerts

  • Customer
    Any person who:
  • Holds an insurance policy with Mazel Insurance Brokers Pvt. Ltd
  • Has applied for insurance
  • Uses WhatsApp services, or
  • Avails any insurance product offered by Mazel Insurance Brokers Pvt. Ltd

  • The Customer is responsible for securing their phone, WhatsApp account security, SIM protection, and device access control. The Company is not liable for phone loss, WhatsApp compromise, or SIM cloning.

    Customer Information
    Personal and sensitive details of the Customer such as policy details, premium information, and claim data, shared or collected while using services. Customer data may be transmitted via the WhatsApp platform, processed by insurer APIs, stored on third-party servers, and accessed by authorized vendors.

    Registered Customer Number
    The mobile number registered by the Customer with BasketOption.Insure for communication.

    Device
    Any device like mobile phone, laptop, tablet, or computer used to access WhatsApp services.

    Automated Bot Disclosure
  • The Customer acknowledges that responses provided via WhatsApp may be generated through automated chatbot systems.
  • Human intervention may not always be involved.
  • Information shared via WhatsApp may be system-generated based on available data sources.

  • One Way Communication
    Service where Mazel Insurance Brokers Pvt. Ltd sends alerts and updates such as premium reminders, claim updates, and policy notifications.

    Two Way Communication
    Service where the Customer can send queries, request policy details, or ask for support, and the Company responds as per its approved services.

    Privacy Commitment
    Mazel Insurance Brokers Pvt. Ltd is committed to protecting and safeguarding customer data as mentioned on its official website.

    Privacy Policy
    The official privacy policy of BasketOption.Insure explaining how customer data is collected, used, and protected.

    Services
    Includes both One Way and Two-Way Communication provided through WhatsApp.

    Website
    The official website of BasketOption.Insure (Mazel Insurance Brokers Pvt. Ltd).

    WhatsApp
    The messaging application provided by WhatsApp Inc. used for customer communication.


    2. Interpretation

  • Singular & Plural: Words in singular include plural and vice versa. The word “includes” means without limitation.
  • Gender & References: Words referring to one gender include all genders. “We/Us” refers to Mazel Insurance Brokers Pvt. Ltd and “You/Your” refers to the Customer using WhatsApp services.
  • Legal References: Any reference to a law or regulation includes all amendments, updates, re-enactments, or replacements in force from time to time.
  • Headings: Headings, bold text, or italics are for convenience only and do not affect the meaning of these Terms and Conditions.
  • Applicable Laws: Reference to any law, rule, regulation, order, or guideline means any applicable legal requirement in force, including future amendments.

  • 3. Purpose
    The WhatsApp platform acts as an additional communication channel through which BasketOption.Insure may interact with you, provide services, and enable selected insurance-related services at its sole discretion.


    4. Eligibility for Using the Services
    The Customer agrees to use the Services only if he/she meets the following conditions:

  • The Customer is an individual and a major (18 years or above).
  • The Customer is a legal guardian acting on behalf of a minor.
  • The Customer is of sound mind, financially solvent, and legally competent to enter into a contract.
  • The Customer is a resident of India.
  • The Customer is a Non-Resident Indian (NRI) or Person of Indian Origin (PIO) as defined under the Foreign Exchange Management Act, 1999 (FEMA).

  • 5. Applicability of WhatsApp Terms and Conditions
    These WhatsApp Terms and Conditions form a binding contract between the Customer and Mazel Insurance Brokers Pvt. Ltd. By opting for the Services, the Customer confirms acceptance of:

  • (a) These WhatsApp Terms and Conditions.
  • (b) The Mazel Insurance Brokers Pvt. Ltd Privacy Commitment.
  • (c) The applicable Privacy Policy (including policies for NRI/PIO or customers residing outside India, including EU residents).
  • (d) Any other policy/product/service-specific terms and conditions.
  • (e) The applicable terms, guidelines, and privacy policy of WhatsApp Inc.

  • Mazel Insurance Brokers Pvt. Ltd may modify the process of authentication, registration, or verification for One Way or Two-Way Communication at its sole discretion.

    No delay or omission by Mazel Insurance Brokers Pvt. Ltd in exercising its rights shall affect its powers or remedies under these Terms.

    The Customer grants express authority to Mazel Insurance Brokers Pvt. Ltd to act upon requests received through its Registered Company Number on WhatsApp.

    If a request is received from the Registered Customer Number, Mazel Insurance Brokers Pvt. Ltd shall presume that the request is made by the Customer. The Company may rely on its system records or transaction logs as final and binding proof of communication.


    6. User Consent for WhatsApp Communication
    The Customer provides explicit consent to receive WhatsApp communication by:

  • (a) Initiating chat with the Registered Company Number; or
  • (b) Opting in through employer/company; or
  • (c) Registering their mobile number for Services.

  • Such consent includes permission for:
  • (a) Automated responses
  • (b) Policy alerts
  • (c) Renewal reminders
  • (d) Service notifications
  • (e) Marketing communication (where applicable)

  • 7. Scope of WhatsApp Insurance Services
    The Services available through WhatsApp may include:

  • (a) Retrieval of insurance e-cards
  • (b) Display of claim status
  • (c) Network hospital search
  • (d) Policy information enquiry
  • (e) Automated service responses
  • (f) Alerts, reminders, and notifications

  • The Company reserves the right to modify, add, remove, or suspend any Service without prior notice.


    8. Services

  • Discretion of Services: Mazel Insurance Brokers Pvt. Ltd reserves the right to offer only such Services as it may decide from time to time.
  • Service Updates: The Company may inform or update Customers regarding the availability or non-availability of any Service at its discretion.
  • Modification or Discontinuation: The Company may modify, suspend, discontinue, or reject any Service request (including for not meeting eligibility criteria) without prior notice.
  • No Responsibility for Certain Issues: The Customer agrees that BasketOption.Insure shall not be held responsible for: (a) Non-response or delayed response to queries; (b) Responses not meeting Customer expectations; (c) Messages not received, incorrectly formatted, outside the scope of Services, or affected due to technical or other reasons.
  • Additional Communication Channel: WhatsApp is only an additional communication channel. Services may also be available through other official channels of Mazel Insurance Brokers Pvt. Ltd.
  • Third-Party Platform: The Company shall not be liable for fraud, impersonation, or issues arising through the WhatsApp platform, which is operated by WhatsApp Inc.
  • Financial Transactions (If Applicable): If any Service involves financial transactions (such as premium payments or refunds), it shall be subject to statutory/regulatory limits or internal limits set by the Company. The Customer authorizes the Company to debit or credit the relevant policy account for completing the requested Service.

  • 9. Unsubscribe

  • Customer Un-subscription: The Customer may request de-registration or un-subscription from WhatsApp Services at any time by following the process prescribed by BasketOption.Insure.
  • Available Channels (Currently): (a) Through the Mazel Insurance Brokers Pvt. Ltd Website (OTP-based verification); (b) Via missed call or SMS to the number provided on the Website; (c) By sending “STOP” on WhatsApp to the Registered Company Number.
  • Effective Date: Un-subscription may take reasonable time to process. The Customer remains responsible for any requests or messages sent before cancellation is completed.
  • Right to Terminate: Mazel Insurance Brokers Pvt. Ltd may suspend, discontinue, or terminate the Services at any time without assigning any reason, especially in case of breach of these Terms.
  • Post Un-subscription: Once un-subscription is confirmed, Mazel Insurance Brokers Pvt. Ltd will stop processing Customer information and sending WhatsApp messages, except where legally required or permitted.

  • 10. Important Terms

  • i. The Customer shall apply for the Services (or any changes) in the manner prescribed by BasketOption.Insure, including website forms, customer care, SMS, or other approved modes.
  • ii. The Company will decide which devices, software, platforms, and networks are supported. Use of unsupported or modified versions (“Unauthorized Use”) will result in immediate suspension of Services.
  • iii. The Customer is responsible for upgrading their device, software, and WhatsApp application at their own cost. The Company is not obligated to support outdated systems.
  • iv. By subscribing, the Customer agrees to receive notifications via WhatsApp, including policy details, premium updates, offers, new products, and important communications.
  • v. The Customer authorizes the Company to access relevant policy account details to process Service requests and share necessary information with authorized third parties.
  • vi. Policy-related Services (including claims, premium, loan against policy, etc.) will be provided only to the WhatsApp account linked to the Registered Customer Number.
  • vii. Responses on WhatsApp are system-generated and may not always provide detailed information. For further clarification, Customers must contact official support channels. The Company is not liable for unsatisfactory responses.
  • viii. The Company may seek Customer consent on WhatsApp to send offers and updates, and such consent will be recorded.
  • ix. Mazel Insurance Brokers Pvt. Ltd and its affiliates may collect, store, use, and process Customer information for providing Services, analysis, fraud prevention, regulatory compliance, and product offerings, as per applicable law.
  • x. Mazel Insurance Brokers Pvt. Ltd records and system logs of WhatsApp transactions shall be treated as final and binding proof.
  • xi. If instructions are inconsistent or suspicious, the Company may seek clarification or suspend Services to prevent loss.
  • xii. Information/instructions may be transmitted, stored, and accessed by authorized personnel or service providers.
  • xiii. On opting for WhatsApp Services, the Company may discontinue alerts through SMS or other channels.
  • xiv. The Customer is responsible for securing their WhatsApp account linked to the Registered mobile number.
  • xv. The Customer understands that WhatsApp is a third-party platform operated by WhatsApp Inc., and may involve risks such as interception, fraud, delay, or data misuse. Mazel Insurance Brokers Pvt. Ltd is not liable for such risks.
  • xvi. The Customer uses the Services at their own risk, including risks such as unauthorized access, identity theft, viruses, password misuse, or technology failures. Any suspected misuse must be immediately reported through official channels.
  • xvii. Services may be interrupted due to technical or system issues. The Company does not guarantee uninterrupted availability.
  • xviii. The Customer must keep passwords confidential and is responsible for all communications made through their account.
  • xix. Mazel Insurance Brokers Pvt. Ltd and its employees shall not be liable for any direct or indirect damages arising from use or inability to use the Services.
  • xx. The Customer shall not copy, reproduce, or commercially exploit any part of the Services.
  • xxi. Proper data network connectivity is the Customer’s responsibility. The Company is not liable for message delays or non-receipt.
  • xxii. The Customer shall not transmit unlawful, obscene, infringing, confidential, or prohibited content via WhatsApp.
  • xxiii. The Company may remove inappropriate or rule-violating content without notice.
  • xxiv. Instructions must be sent from the Registered Customer Number. The Customer is responsible for accuracy and authenticity of instructions.
  • xxv. If any error is noticed in information provided, the Customer must inform the Company promptly. Information may not always be real-time, and the Company is not liable for reliance on such data.
  • xxvi. Customers are advised to delete WhatsApp from old devices when changing devices to prevent misuse.
  • xxvii. All Services are subject to applicable laws and regulations, including those issued by the Insurance Regulatory and Development Authority of India and other authorities.
  • xxviii. The Company may withdraw or suspend the Customer’s access to Services at its discretion without notice.
  • xxix. The Registered Company WhatsApp Number cannot be used for grievance redressal or fraud reporting. Customers must contact official support channels for such matters.
  • xxx. These WhatsApp Terms and Conditions may be modified, withdrawn, or replaced at any time without prior notice.

  • 11. Corporate / Group Policy Employee Access

  • Where insurance coverage is provided under a group policy, employees access Services as beneficiaries of the employer’s master policy.
  • The employer remains the master policyholder where applicable.

  • 12. Third Party

    Third-Party Platform Disclaimer

  • Independent Platform: WhatsApp is owned and operated by WhatsApp Inc., a third party not affiliated with BasketOption.Insure.
  • No Control Over WhatsApp Policies: The Company has no control over WhatsApp’s terms, privacy policies, or guidelines. Customers must independently review and follow WhatsApp’s policies.
  • No Responsibility for Third-Party Content: BasketOption.Insure does not endorse or take responsibility for any advertisements, content, products, opinions, or materials promoted through WhatsApp or other social media platforms.
  • Monitoring by WhatsApp/Service Providers: WhatsApp or other service providers may monitor, review, store, or share communications exchanged through the platform with third parties as per their policies.

  • Customer Advisory
    Customers are strongly advised to:
  • i. Avoid sharing sensitive or confidential information through WhatsApp.
  • ii. Understand that the Company will only respond to Customer messages, except for important alerts or awareness communications.
  • iii. Not use WhatsApp for complaints, grievances, fraud reporting, or urgent matters. Such issues must be addressed through official customer support channels.

  • 13. Disclaimer of Liability

    1. Not Responsible for Network Issues
    The Company is not liable if:

  • You cannot use WhatsApp services due to network/geographical issues.
  • Your telecom provider fails.
  • There is system failure, technical error, or service interruption.
  • Service is unavailable due to natural calamities, pandemics, legal restrictions, etc.

  • 2. You Must Inform the Company Immediately If:
  • Your phone is lost.
  • Your SIM is lost or duplicated.
  • Your mobile number is reassigned to someone else.
  • You notice unauthorized transactions.
  • Failure to inform the Company in time may make you responsible for losses.

    3. Customer Responsibility for Security
    You are fully responsible for:
  • Protecting your OTP, PIN, passwords, and mobile number.
  • Keeping your SIM, device, and WhatsApp secure.
  • Unauthorized access due to SIM cloning, viruses, or device misuse.
  • Transactions initiated from your registered mobile number (even if not done by you).

  • 4. Not Liable for Unauthorized Transactions If:
  • Someone had access to your phone.
  • You delayed reporting fraud.
  • You failed to update your changed mobile number.
  • There was misuse of your device or SIM.
  • There was WhatsApp account compromise.

  • 5. No Guarantee on WhatsApp Security
    The Company:
  • Does not guarantee confidentiality or security of WhatsApp messages.
  • Is not responsible for data breaches on WhatsApp.
  • Is not liable for disputes between you and WhatsApp or your telecom provider.

  • 6. No Compensation for Losses
    The Company will not be liable for any damages, including:
  • Direct or indirect financial loss
  • Loss of revenue or business
  • Data loss
  • Service delays or errors

  • 7. Misuse Consequences
    If you misuse WhatsApp services:
  • The Company may charge financial penalties.
  • Your service may be suspended.

  • The WhatsApp service is provided on a “best effort” basis. Most security and usage responsibility lies with the Customer. The Company limits its liability in almost all situations.


    14. Claim Status Limitation

  • Claim status displayed on WhatsApp is for informational purposes only.
  • Displayed status does not constitute claim approval, rejection, or settlement confirmation.
  • Final claim decisions rest solely with the respective Insurance Company.

  • 15. Third-Party Data Source Clause

  • Information is fetched via APIs from insurance companies.
  • BasketOption.Insure does not generate policy or claim data.
  • Accuracy depends on insurer systems.
  • Delays/errors from insurer servers are not our liability.

  • 16. Data Flow & Storage Disclosure
    Customer data may be:

  • (a) Transmitted via WhatsApp platform
  • (b) Processed through insurer APIs
  • (c) Stored on third-party servers
  • (d) Accessed by authorized vendors/service providers

  • WhatsApp servers may be located outside India. The Company does not control data storage practices of WhatsApp.


    17. Authentication & Verification

  • Access to certain Services may require OTP verification or mobile number authentication.
  • The Registered Customer Number shall be treated as authenticated identity for WhatsApp Services.

  • 18. No Financial or Insurance Advice

  • Information shared via WhatsApp shall not be construed as financial, investment, underwriting, or insurance advice.
  • Customers are advised to consult official policy documents and insurer communications for final decisions.

  • 19. Fraud & Misuse
    The Company may suspend or restrict access if:

  • (a) Suspicious activity is detected
  • (b) Misuse of the platform occurs
  • (c) Unauthorized automation access is attempted

  • 20. Limitation of Liability
    The Company shall not be liable for:

  • (a) Insurer errors
  • (b) Claim rejection decisions
  • (c) API failures
  • (d) Platform downtime
  • (e) Data inaccuracies from third parties

  • Liability, if any, shall be limited to cases of wilful misconduct or gross negligence.


    21. Grievance Redressal

  • WhatsApp shall not be treated as a formal grievance redressal channel.
  • Customers must use official support channels for complaints, disputes, or regulatory escalation.
  • Grievances shall be handled in accordance with applicable regulations of the Insurance Regulatory and Development Authority of India.

  • 22. Regulatory Compliance (WhatsApp Services)

  • BasketOption.Insure operates in accordance with applicable Indian insurance laws and regulations.
  • All Services are subject to guidelines issued by the Insurance Regulatory and Development Authority of India (IRDAI).
  • In case of conflict between these Terms and regulatory requirements, applicable regulations shall prevail.

  • 23. Indemnity
    In consideration of Mazel Insurance Brokers Pvt. Ltd providing the Services on WhatsApp, the Customer, at his/her own expense, agrees to indemnify, defend and hold harmless Mazel Insurance Brokers Pvt. Ltd, its directors, employees, representatives, agents, customers and/or affiliates, as the case may be, against all losses, damages, expenses, actions, claims, demands and proceedings whatsoever that the Company may incur, sustain, suffer or be put to at any time as a consequence of acting on, omitting, or refusing to act on any instructions given by the Customer or otherwise in connection with the use of the Services on WhatsApp.

    The Customer further specifically agrees to indemnify, defend and hold harmless the Company from any losses occurring as a result of:

  • i. The Customer permitting any third parties to use the WhatsApp facility.
  • ii. The Customer permitting any other person to have access to his/her mobile phone, or as a consequence of leaving the mobile phone unattended, or loss of the mobile phone, and the Company acting or not acting on any instructions received from the same.
  • iii. The Customer having breached the WhatsApp Terms and Conditions.

  • 24. Termination
    Mazel Insurance Brokers Pvt. Ltd may, at its sole discretion, temporarily withdraw or terminate all or any of the Services on WhatsApp, either wholly or in part, at any time without giving prior notice to the Customer.

    The Company may, without prior notice, suspend all or any of the Services on WhatsApp at any time during which any maintenance work or repair is required to be carried out, or in case of any emergency or for security reasons that require the suspension of the Services.

    The Company may suspend or terminate the Services on WhatsApp without prior notice if the Customer has breached these WhatsApp Terms and Conditions or if the Company becomes aware of the Customer’s death or bankruptcy.


    25. Proprietary Rights
    The Customer acknowledges that the software and/or other internet-related software required for providing the Services, and any Intellectual Property Rights of BasketOption.Insure involved in the process, are the legal property of BasketOption.Insure and/or the respective service providers.

    The permission granted by BasketOption.Insure to the Customer to avail of the Services does not create or convey any rights, title, or interest to the Customer or to any other person in such software or in the Intellectual Property Rights of BasketOption.Insure.

    The Customer agrees that he/she shall not attempt to modify, translate, disassemble, decompile, reverse engineer, or create any derivative works based on such software or related systems.


    26. Disclosure
    The Customer hereby expressly authorizes and gives consent to Mazel Insurance Brokers Pvt. Ltd to collect, share, exchange, disclose, transfer or part with any Account information or personal data provided to or available with the Company, when it considers such disclosure necessary or expedient, with:

  • (a) WhatsApp, employees or agents of Mazel Insurance Brokers Pvt. Ltd group entities, subsidiaries, and branches in any jurisdiction.
  • (b) Auditors, agencies/credit bureaus, any court or tribunal, or any statutory, regulatory, judicial, governmental or administrative authority, Central KYC Registry, SEBI Know Your Client (KYC) Registration Agency, or any authority having jurisdiction over the Company or its group entities/subsidiaries/branches.
  • (c) Service providers or any person with whom the Company contracts or proposes to contract in relation to the provision of Services in respect of the Account or facilities.

  • For the purpose of:
  • i. Compliance with applicable laws or any judicial, statutory or regulatory requirement.
  • ii. Facilitating transactions or any of the Services through the WhatsApp platform or otherwise.
  • iii. Disclosures for credit review of any account, assets, services, or credit facilities received/availed/held by the Customer.
  • iv. Authentication or verification purposes.
  • v. Research or analytical purposes, credit reporting, credit scoring, risk management, anti-money laundering checks, or participation in any telecommunication systems.
  • vi. Designing financial or insurance services and offering an enhanced, personalized online experience on the website and third-party websites or otherwise.
  • vii. Enabling registration, verification, or offering of any products or investments to be made by the Customer with the Company’s group companies or other companies.

  • The Customer understands and agrees that the Company has deployed processes and technology to prevent unauthorized use or accidental disclosure of Customer Information or any other data pertaining to the Customer on WhatsApp. The Customer further understands and accepts that by using the Services, Customer Information and other related data may also be stored on the application, website, webpage, or servers of WhatsApp, which are outside the control of the Company, and the Company cannot guarantee the security of such information or data stored therein.

    The use of such information and data shall be governed by WhatsApp’s applicable guidelines and policies. The Customer unconditionally and irrevocably agrees and accepts that the Company shall not be responsible for any use, misuse, or compromise of Customer Information/data outside its control and acknowledges that the Customer is providing such information at his/her own free will and risk.


    27. Governing Law (WhatsApp Services)
    These WhatsApp Terms and Conditions shall be governed by the laws of India. Any dispute or differences arising out of or in connection with the Services available on WhatsApp or any of the Services shall be subject to the exclusive jurisdiction of the Courts of Mumbai.

    Mazel Insurance Brokers Pvt. Ltd accepts no liability whatsoever, whether direct or indirect, for non-compliance with the laws of any country other than India. The mere fact that the Services on WhatsApp may be accessed by a Customer from a country other than India shall not imply that the laws of such country govern these Terms and Conditions and/or the operations of any accounts, services, products, offers provided to the Customer, and/or the use of the Services on WhatsApp.


    28. Disclaimer (WhatsApp Services)

  • Mazel Insurance Brokers Pvt. Ltd may, at its sole discretion, utilize the services of external service provider(s) or agent(s) and on such terms as required or necessary, in relation to its products and/or Services provided.
  • WhatsApp or any other service provider through which the Services are provided on WhatsApp may review, monitor, and store the contents (including text, images, videos, or other materials) shared or communicated through the WhatsApp platform, and may share or disclose the same with third parties in accordance with their applicable policies.
  • Mazel Insurance Brokers Pvt. Ltd shall not be involved in, or in any way liable to the Customer for, any dispute between the Customer and a cellular service provider, any third-party service provider, or WhatsApp (whether appointed by the Company for such purpose or otherwise) while availing these Services through WhatsApp. The Customer agrees to directly take up any claim or dispute relating to the usage of the WhatsApp platform with WhatsApp or the relevant service provider.
